Execution Instructions - Financial Institution/Bank Levy

This is the form to complete when you, as the creditor, have been issued a Writ of Execution and would like to levy on the debtor’s bank account. The bank must be within Sherburne County in order for our office to conduct the levy. The top portion of the form is where you would list the debtor’s name and home address. If you know their account number, please provide that as well. The next section outlines specific steps you need to complete prior to requesting the Sheriff’s Civil Division to serve the bank levy. If your judgment is against an individual, you will need to complete the Important Notice form, Instructions form, and the first page of the Exemption Form. The bottom portion of the form is where you list your name, address, phone number (or that of your attorney), date and sign the form. If you are mailing the forms and checks to our office, be sure that you endorse the Writ of Execution.

Important Notice/Instructions and Exemption Form

These are the forms that must accompany a Writ of Execution for a bank levy.

Important Notice form: Complete the top portion. The County is the same as the County issuing the Writ of Execution. The Creditor is you, the Debtor is the individual(s) you won the judgment against, and the Financial institution is the name of the bank.

Instructions form: Fill in the date in item #3. Complete the bottom portion of the form listing your name and address (or that of your attorney), and the name and address of the bank.

Exemption Form: Complete the top portion of the first page. The County is the same as the County issuing the Writ of Execution. The Creditor is you, the Debtor is the individual(s) you won the judgment against, and the Financial institution is the name of the bank. The rest of the form is for the debtor to complete.

Execution Instructions - Wage Levy

This is the form to complete when you, as the creditor, have been issued a Writ of Execution and would like to garnish/levy on the debtor’s wages. The place of employment must be within Sherburne County in order for our office to conduct the levy.

The top portion of the form is where you would list the debtor’s name and home address. The next section outlines specific steps you need to complete prior to requesting the Sheriff’s Civil Division to serve the wage levy. Note that an Execution Exemption Notice must be mailed to the debtor’s last known address 10 days before delivering the Writ of Execution to the Sheriff’s Office for service. This is also where you specify the employer and their address. The bottom portion of the form is where you list your name, address, phone number (or that of your attorney), date and sign the form.

If you are mailing the forms and checks to our office, be sure that you endorse the Writ of Execution.

Execution Exemption Notice - Wage Levy

This is the form to complete when you attempt to garnish/levy against wages. This form must be mailed to the debtor’s last known address ten (10) days prior to requesting the Sheriff’s Civil Division to serve a Writ of Execution. The form consists of three (3) pages, complete the top portion of the first page and the bottom portion of the second page. When completing the first page, the County is the same as the County issuing the Writ of Execution. The Judgment Creditor is you, the Judgment Debtor is the individual(s) you won the judgment against, and the Third Party is the employer. The information requested on the second page is your name (or that of your attorney), address, phone number and date. The third page of the form is completed by the debtor.

Request for Service
This is the form to complete when requesting the Sherburne County Sheriff’s Office to serve papers.  Please complete and submit this form with every process being brought or mailed to the Sheriff’s Civil Division for service. The top portion is information on the party being served. Please include any information you can that will aid in the service of the papers (best time to serve, work hours). Be sure to fill out the information at the bottom of the page.

Request for Certificate of Redemption

This is the form to complete when requesting a payoff figure to redeem a foreclosed property, whether you are redeeming as the owner or a creditor. Your request should be made a minimum of 10 days prior to the day you wish to redeem. Please complete all information including whether you are redeeming as the mortgagor (owner) or as a creditor.

Redemptions are conducted between 9:00 am and 4:00 pm Monday through Friday, with the exception of legal holidays. At the time of redemption we will require a certified bank check or cashier’s check for the entire amount payable to Sherburne County Sheriff.

The Sherburne County Sheriff’s Office does not issue certificates of redemption for short sales. If the redemption involves a short sale, contact the lender/mortgage company or their attorney directly.

Affidavit of Mailing

An Affidavit of Mailing is the form a plaintiff files with the court administrator if the Sheriff’s office POSTS an Eviction Summons and Complaint. The Sheriff’s office will notify the plaintiff if the Eviction Summons were posted and the plaintiff in the action is required to mail a copy of the Summons and Complaint to the defendants by first class mail. The plaintiff must complete and file a notarized Affidavit of Mailing with the court administrator.
